We are hearing that many farmers are having to pay back 2022 ERP due to "games" by USDA
We are hearing of many cases where farmers are having to pay back 2022 ERP if they indicated that every acre of eligible crops were insured by crop insurance. The payback is required if even one acre of marginal land that is not even being planted to a crop is not “insured”.
We believe that since federal courts have ruled that USDA’s practice of only reimbursing crop insurance premiums for underserved farmers is unconstitutional that they are now playing games to get refunds back from farmers due to “flimsy” reasons.
