Update on Ogallala Water Depletion
In my previous post this week I failed to mention that Rev. Rul. 82-214 specifically allowed depletion in all of the Ogallala aquifer.
We did a post earlier this week on depleting water if you can prove that your aquifer is being depleted. The key court case on this is the Shurbet case from 1965.
