Will You Have to File a BOI This Year

Although the Supreme Court lifted the injunction on filing BOI reports, it appears the new administration is not interested in forcing these filings

Last week the Supreme Court lifted the injunction on filing Beneficial Ownership Information (BOI) reports. However, FinCEN elected to postpone any filing of BOI reports for now. Therefore, you are not required to file any BOI reports for the foreseeable future.

FinCEN indicated that there is other litigation regarding the Samantha Smith and Robert Means v. United States Department of the Treasury. That is another Texas case and the court in that decision also granted an injunction against FinCEN enforcing the BOI reporting requirements. However, that injunction was just for the two plaintiffs and any related entities. It was not a national injunction.
